MENIFEE — A 16-year-old relative of Terry Smith was arrested Wednesday, accused of murder in the disappearance of the autistic boy from Menifee.
The body of a boy who fits the description of 11-year-old Terry was found overnight in a “shallow grave containing partially exposed human remains,” Capt. John Hill said.

Investigators were still working to confirm the body belonged to Terry, who was last seen Saturday near his home in Menifee.
The Riverside County District Attorney’s Office is waiting for investigators to forward the criminal case to prosecutors for review, spokesman John Hall said. He did not know how quickly that could happen.
Terry’s 16-year-old half brother, whose name has not been released, was the last one to see Terry near his home on Saturday, according to the Riverside County Sheriff’s Department.
Earlier this week, sheriff’s spokesman Deputy Albert Martinez told The Desert Sun, the teen told investigators he was “walking away from their residence, turns back, sees that Terry’s following him and tells Terry, ‘Hey, go home.’ ”
The half brother, who has the same mom as Terry, has been “questioned several times by investigators,” Martinez said Tuesday afternoon.
“He’s been cooperative throughout the whole time,” the deputy said.
